Terms of Service

These Terms of Service ("Terms") govern your use of the DentalAI platform ("Service") operated by Dent-Selfy Dental Clinic ("we", "us", "our"). By creating an account or using the Service, you confirm that:

• You are at least 16 years old
• You have the legal capacity to enter into this agreement
• You have read and understood our Privacy Policy and Medical Disclaimer
• You agree to be legally bound by these Terms

The Service provides:

• AI-generated preliminary assessment of dental images
• Educational information about dental conditions
• Connection to qualified dental professionals (Dent-Selfy Clinic)
• Tracking of your consultation history

The Service does NOT:

• Provide medical diagnoses
• Prescribe treatments or medications
• Replace examination by a licensed dentist
• Constitute emergency dental care

3.1 Registration: You must provide accurate, current, and complete information during registration.

3.2 Security: You are responsible for:

• Maintaining the confidentiality of your password
• All activities under your account
• Notifying us immediately of any unauthorized access

3.3 Age Requirement: The Service is intended for users aged 16 years or older. Users under 18 should obtain parental/guardian consent.

3.4 One Account Per User: You may only create one account. Multiple accounts may be terminated.

You agree NOT to:

• Upload images that are not your own dental photographs
• Provide false information about yourself or your condition
• Use the Service for illegal purposes
• Attempt to bypass security measures
• Reverse engineer, decompile, or hack the Service
• Use automated systems (bots, scrapers) to access the Service
• Resell, redistribute, or commercialize the Service
• Upload malicious content, viruses, or harmful code
• Harass, abuse, or harm other users or staff
• Impersonate any person or entity

5.1 Our Content: All content on the Service (logos, software, designs, AI models) is owned by Dent-Selfy and protected by intellectual property laws. You may not copy, modify, or distribute without written permission.

5.2 Your Content: You retain ownership of images and information you upload. By using the Service, you grant us a limited, non-exclusive license to process your data solely for providing the Service.

5.3 AI-Generated Analysis: The AI analysis results are provided to you for personal informational use only.

The Service is currently provided free of charge. We reserve the right to introduce paid features in the future with prior notice to existing users.

To the maximum extent permitted by law:

• We are NOT liable for any health decisions you make based on AI analysis
• We are NOT liable for indirect, incidental, or consequential damages
• We are NOT liable for service interruptions or data loss
• Our total liability shall not exceed €100 EUR or the amount paid by you (if any)

Note: Some jurisdictions do not allow exclusion of certain warranties. These limitations may not apply to you to the extent prohibited by law.

You agree to indemnify and hold harmless Dent-Selfy, its affiliates, and employees from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Health decisions made based on AI analysis

9.1 By You: You may terminate your account at any time by contacting us at artipylon@gmail.com.

9.2 By Us: We may suspend or terminate your account if you:

• Violate these Terms
• Provide false information
• Engage in fraudulent activity
• Pose a security risk

9.3 Effect of Termination: Upon termination, your data will be deleted within 30 days, except where retention is required by law.

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service
• Update these Terms with 30 days notice via email
• Change features, content, or technical specifications

Continued use after changes constitutes acceptance of revised Terms.

The Service integrates with third-party providers:

• OpenAI: AI analysis processing
• SendGrid: Email delivery
• WhatsApp: Optional clinic communication

We are not responsible for third-party services. Their terms and privacy policies apply when using their features.

12.1 Governing Law: These Terms are governed by the laws of the European Union (where applicable) and Azerbaijan Republic, without regard to conflict of laws principles.

12.2 EU Users: EU consumers benefit from mandatory provisions of their country's laws.

12.3 Dispute Resolution: Disputes shall be resolved through:

1. Good-faith negotiation (30 days)
2. Mediation (recommended)
3. Courts of Baku, Azerbaijan (for non-EU users)
4. For EU users: courts of your country of residence

12.4 ODR Platform: EU consumers may use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr

We are not liable for failures due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, internet outages, government actions, or third-party service failures.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Dent-Selfy regarding the Service.

You must be 18 years of age or older to create an account or use DentalAI. By creating an account, you confirm that you meet this requirement.

You may upload only photos of your own teeth. You must not upload photos of children or of any other person, and you must provide accurate information about yourself and your symptoms.

DentalAI provides preliminary information based on photos. It is not a medical diagnosis or treatment and does not replace an examination by a dentist. In an emergency, contact a dentist or emergency services immediately.

If we learn that an account belongs to a person under 18, or that the service is being used in breach of these terms, we may suspend or delete the account and its data.
